Request Expungement of Disciplinary Action

KBN actions, consent decrees, agreed orders, and decisions are subject to expungement if the discipline meets certain regulatory requirements.​

Generally, if all the terms of the action have been met:

  • Consent decrees may be expunged after 3 years​
  • ​Agreed orders and decisions that resulted in a plain reprimand may be expunged after 5 years; and
  • Agreed orders and decisions that resulted in a complex reprimand may be expunged after 10 years. A complex reprimand is one that involves an encumbrance on the license, such as drug screening, monitoring, probation, suspension, or revocation.

Please note:

  • ​The periods listed above do not begin to run until the terms of the action have been satisfied.
  • ​Expungement of a consent decree or disciplinary action is not available if there is a pending investigation.​
  • Expungement of disciplinary action is also unavailable if there is subsequent disciplinary action that is also ineligible for expungement.
