Criminal History

KRS 314.011(21) defines conviction as an unvacated adjudication of guilt, pleading no contest or nolo contendere, entering an Alford plea, or entering a guilty plea pursuant to a pretrial diversion order regardless of whether the penalty is rebated, suspended, or probated.  

On your application for licensure, you must report and submit documentation of felonies and/or misdemeanors.  You are required to report and submit the following documentation under Criminal History (Section 5) on the application form:

ALL FELONIES Certified court documents and a detailed letter of explanation.
All Misdemeanors received within 5 years of the date of application Certified court documents and a detailed letter of explanation.
ALL DUI's (Driving under the Influence) Certified court documents and a detailed letter of explanation.
All Misdemeanors received prior to 5 years of the date of the application. No documentation is required.

Traffic offenses, OTHER THAN DUI's, do not have to be reported.
